The EIA Directive 2014/52/EU amends Directive 2011/92/EU on the assessment of the effects of certain public and private projects on the environment and was due to be transposed into Irish Law by the 16th May 2017. This hasn’t happened but the Department of Housing, Planning Community and Local Government has launched a consultation process on the transposition of the new Directive. The closing date is June 2nd 2017. A key issues document has been produced which outlines how the Department envisages transposing the new directive, a link to the document is here.
Subsequent to the launching of the public consultation, Circular Letter PL 01/2017 Implementation of Directive 2014/52/EU on the effects of certain public and private projects on the environment (EIA Directive) issued to competent authorities in the planning system. This Circular advises competent authorities to consider applying the requirements of the 2014 Directive in advance of completion of the transposition into law.
